Kaiser sent me the Cease & Desist notice again, postmarked March 16. This notice names the site I set up for the OCR that Kaiser took down last week. I don't get the point of this second C&D notice. Kaiser knows I voluntarily promised not to repost the Systems Diagrams at the hearing on March 16.
I have not yet been served with the order from the DMHC. But in a wild coincidence, the DMHC sent a letter saying it is closing my case since it has "complied with its responsibilities under the Knox-Keene Health Care Service Plan Act of 1975". The DMHC let Kaiser get away with not interviewing the right physician!!!
It seems like having the right the right physician interviewed is well within my rights. The timing of the letter as well as the ridiculous decision makes me think the DMHC has been asked by Kaiser to assist in harrassing me.

I'm leaving this email to Chris up because it reiterates (as the HIPAA complaint does as well as emails to other people at that time) that I only intended to keep the Systems Diagrams posted temporarily until I could raise awareness and get the complaint addressed by the Office of Civil Rights.

For anyone on the Bay Area, I will be on NBC Channel 11 News at 6:20 this evening. I'm sure I will look pretty awful on TV. However, I'm hoping it will show I'm not the Scary Person Kaiser has been trying to paint me as. We discussed Kaiser's invasion of my privacy, which triggered the Kaiser-focus of this blog, so I hope people will also see I value privacy highly, and that I wanted to raise awareness of a violation so the victims would be able to take action. I didn't want other people to suffer Kaiser's blockading tactics like I had.
Also, I was finally served with the DMHC Order. It looks like I may have more luck getting an attorney on that front since public policy is involved.
Ps. To the person who just threatened me in the comments. Your IP address is 162.119.232.103. That is a Kaiser IP address. I have kept a copy of what you wrote to demonstrate how I've been harmed by the DMHC Order.

Hmmm. Just watched the NBC interview. They cut out my whole story about being terrorized in my own home by Kaiser's Private Investigator. I can't tell you how upset I am they cut that out. NBC promised to explain why I did what I did, but then they cut out the part where I explained!
It also makes it look like I said "I'm going to do this to you" in relation to the System Diagrams. At that point I was referring to when I started "naming names" and posting information about Kaiser, not patients. This made it look like I linked to the Systems Diagrams out of retaliation, which is untrue. I linked to the Systems Diagrams to expose something that Kaiser had done wrong, because I wanted to prevent Kaiser from covering it up, and I hoped there might be a bonus in that Kaiser would respond in a way that would demonstrate some of their sleazy tactics. I accomplished the first two goals, but the third is up in the air: Kaiser is indeed engaging in sleazy tactics, but I'm not sure what the balance is between the people who see it, and the people who are just soaking up Kaiser's "key messages".
I also think the interview didn't make it clear that I found the System Diagrams hanging out there on the Internet. I think the interview makes it look like I linked to some secret Kaiser system that happened to be leaking, not a public Tripod web site.
I'm not sure whether NBC shafted me here or whether the interview was just cut more because they were running late. Scott Budman, the guy who interviewed me, was very nice.
Maybe there's a Kaiser crony who was doing the editing? Or maybe a News Director wanted to spin the story Kaiser's way and was willing to resort to splicing my replies with different questions?
The interview ends with Kaiser's message that "what the former employee did is wrong". Still not a word about Kaiser's own wrong-doing: the posting of the System Diagrams, the delay in informing the 140 patients - and then only to use the publicity to shift the blame to me, and the current smear campaign against me to divert attention from the fact that Kaiser has yet to apologize for a colossal privacy violation (they apologize for inconvenience and apologize for me - which is just another way to rub in their false claim - but they never just fess up and take some responsibility for a change...).What Kaiser did was wrong, and scapegoating me - a person who they had already inflicted tremendous harm on - just makes them more wrong.
Update: I've contacted the reporter Scott Budman to see if he will tell me who did the editing. I'm still having trouble processing the idea that Kaiser would have enough influence over the media that they would actually splice my comments and match them with questions to make my story sound like the one Kaiser wants. There may be no such thing as "fair and balanced" reporting, but to go so far as re-arranging clips to tell the story that someone at NBC wanted rather than reporting what I had to say? I don't think I'll ever be able to believe anything I see on the news ever again. :-(
I've written to Scott to request an electronic format copy of the whole interview that I could post so people could see the actual questions I was replying to.
