Another DMHC Outrage
The DMHC just sent me a copy of their revised Order:

Now I'm disgusted. Just when I think I can't be trampled by the system any more than I already have been, people come up with new abuses.

The version of the Order that I signed did not have #7 in it. What I signed had #6 directly followed by my statement of good faith. The DMHC did not provide me a with a copy on the spot: they said they would send me the revised Order after it was approved. I have now asked the DMHC to provide me with a copy of the agreement I signed.

I don't deny trying to call public attention to the Systems Diagrams or linking to my copy of the evidence on March 9. I said then, and I maintain now, Kaiser would have gotten away with destroying the evidence otherwise. At the time, I certainly didn't expect Kaiser would call 140 people to pin the Systems Diagrams on me or to misrepresent the content of the Systems Diagrams (and note that the suppression of the System Diagrams means Kaiser can say anything they want about them). It is Kaiser's perfidious manipulation of the press which makes how the DMHC's wording important now: the wrong wording is informal corroboration for Kaiser.

If I had known that #7 would be included, I would have asked for language to reflect the evidence in my blog that I was trying to get other people to complain to the OCR before the evidence vanished. My purpose was served even before the first TRO Hearing with the Kaiser lawyers, which is why the restraining order was unnecessary. From that point on, the only purpose served by Kaiser's Injunction and the DMHC Order is to make it look like I was a villain rampantly posting patient information, so that Kaiser (and the DMHC acting on Kaiser's behalf) could heroically "stop" me.

By sneaking #7 back in, the DMHC backs up Kaiser's spokespeople and making it even harder for me to get retractions I've been seeking from the press. I consider this a deal-breaker and just a mean thing to do. I'm not sure if this means there will now be a Hearing. I still don't have legal representation, and there were aspects of the pre-Hearing conference that gave me the impression that Hearing procedures are deliberately rigged in favor of the DMHC. I agreed to keep what went on in the pre-Hearing conference confidential, but I'm going to find out if the confidentiality agreement still holds in light of the sly thing the DMHC did with the revised Order.

If the DMHC does give me a copy of the agreement I signed, I will post it here.

Ps. Senator Feinstein is referring me back to the Governor, and she assures me that the Governor's office will work very hard on my behalf. I wonder if she realizes this will be my third pass by the Governor's office on the government assistance merry-go-round.
